General Terms and Conditions (GTC)

1. Scope of Application
These General Terms and Conditions (hereinafter "GTC") govern the contractual relationship between SOS Contact by Oppo (hereinafter "SOS Contact") and its customers (hereinafter "Customer") for the use of the SOS Contact emergency solution.
2. Subject Matter of the Contract
2.1. SOS Contact offers a comprehensive emergency solution that connects physical items (necklace, bracelet, keychain, sticker) with a personal digital emergency microsite.
2.2. The physical items serve as a method for quick access to the stored emergency data:
- The necklace is equipped with QR code and NFC functions.
- The bracelet, keychain, and sticker are equipped with NFC functions.
2.3. The actual core of the solution is the powerful backend infrastructure, which ensures the secure storage, constant availability, and quick retrieval of vital information. This infrastructure is located on secure Swiss servers and is triple-secured.
2.4. The personal microsite is the central digital hub for all relevant information of the Customer. It is accessible and customizable anytime and from anywhere.
3. Services of SOS Contact
3.1. Provision and maintenance of the secure infrastructure for the emergency data.
3.2. Provision and operation of the personal emergency microsite.
3.3. Provision of the physical SOS element chosen by the Customer (necklace, bracelet, keychain, or sticker).
3.4. Ensuring the retrievability of the stored emergency data via the integrated QR code or NFC functions.
4. Data and Data Protection
4.1. The Customer has full control and the ability to make changes to their data on the microsite independently at any time.
4.2. The following information can be stored on the microsite: emergency contacts, medically relevant data (allergies, chronic conditions, blood type, implants, special notes), name of the user (person or animal), as well as other relevant information such as legal guardians for children, special needs for seniors or room numbers in homes, breed or behaviors for animals.
4.3. If necessary, a note about the existence of a living will and the user's address can be stored. It is explicitly pointed out that the living will itself is not stored on the microsite, but only a reference to its existence.
4.4. SOS Contact undertakes to comply with all relevant data protection regulations, in particular the Swiss data protection laws. The data is stored exclusively on Swiss servers and is triple-secured.
5. Prices and Payment Conditions
5.1. The use of the SOS Contact emergency solution, including the infrastructure and the personal microsite, is subject to an annual fee of CHF 24.90.
5.2. This annual fee is payable in advance.
5.3. The cost for the initial physical SOS element is included in the annual fee.
6. Replacement Devices
6.1. If an SOS element is lost or damaged, the Customer can request a replacement device.
6.2. For replacement devices, only handling, packaging, and shipping costs will be charged.
7. Liability
7.1. SOS Contact is liable for damages resulting from intent or gross negligence.
7.2. Liability for slight negligence is excluded to the extent permitted by law.
7.3. SOS Contact assumes no liability for damages resulting from the incorrect or outdated entry of data by the Customer.
7.4. SOS Contact assumes no liability for the functionality of third-party QR code or NFC readers (e.g., helpers' smartphones).
8. Contract Duration and Termination
8.1. The contract is concluded for a period of one year and is automatically extended by one year at a time, unless terminated in writing by either party with a notice period of [e.g., 30 days] before the end of the respective contract period.
8.2. The right to extraordinary termination for just cause remains unaffected.
9. Amendments to the GTC
SOS Contact reserves the right to amend these GTC at any time. Changes will be communicated to the Customer by e-mail or on the website and are deemed accepted if the Customer continues to use the services after the changes take effect or does not object within a period of 30 days.
10. Severability Clause
Should individual provisions of these GTC be or become ineffective or unenforceable, the validity of the remaining provisions shall not be affected.
11. Applicable Law and Jurisdiction
11.1. Swiss law applies exclusively.
11.2. The place of jurisdiction is the district of Hinwil.
